1. Acceptance of Terms

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing the website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any of these Terms, you must immediately discontinue your use of the website and any related services.

2. Unpaid Invoices

Starting January 1, 2022, services for any unpaid invoice that is more than 30 days past due will be suspended. Suspension applies to all services, including website hosting and SEO services. If your SEO invoice remains unpaid for more than 30 days, your website will be suspended. In this context, “suspended” means your website will become inaccessible. Once the outstanding invoice is paid, services are typically restored within minutes.

Important: If an invoice remains unpaid for over 90 days, we will no longer be responsible for retaining your website content. In such cases, your website (or other services) may be deleted and become irrecoverable. If you are facing financial hardships, please contact Jonas Troyer to discuss potential exceptions or payment arrangements.

3. Purchases

When making a purchase of any product or service through the Service (“Purchase”), you may be required to provide accurate and complete information, including, but not limited to, your name, email address, billing address, shipping address, payment information, and any other relevant details. By providing this information, you agree that it is accurate, current, and complete.

You also acknowledge that you are authorized to use the payment method provided. Failure to provide accurate or valid payment details may result in the cancellation of your order or suspension of services.

4. Subscriptions

Certain services offered by Do It Right Roofing are billed on a subscription basis (“Subscription(s)”). Subscription services, including website maintenance and SEO services, are billed in advance on a recurring basis, either monthly or yearly, depending on the plan you choose. By subscribing, you agree to automatic renewal of the service unless explicitly canceled in accordance with our cancellation policy.

5. Returns, Refunds, and Cancellations

• No Refund Policy: All website services provided by Do It Right Roofing are non-refundable once work has commenced. However, if you cancel before work begins, we will refund your payment in full minus any credit card processing fees. Refunds will be processed within three business days. No exceptions will be made to this policy.
• Cancellation of Subscriptions: Cancellations for website and SEO subscriptions or renewals must be made at least 24 hours prior to the scheduled renewal processing time. Failure to cancel within this time frame will result in the renewal being processed.
• Prepaid Services: If you have prepaid for a year of services but decide not to use the full year, no refund will be issued. However, the remaining balance may be converted into a credit that can be used toward other services. Credit balances must be used within two years (see the Credits section below).

6. Credits

Credit notes may be issued under certain circumstances, such as for unused portions of prepaid services. These credits are subject to the following conditions:

• Credit notes can only be used by the person to whom they were issued and cannot be transferred, sold, or given to another individual.
• Credits may be used for another business owned by the same person.
• All credits expire two years from the date of issuance and have no monetary value once expired.

7. Service Suspension and Deletion Policy

We reserve the right to suspend or delete services in cases of non-payment or violation of these Terms:

• Suspensions: If services are suspended due to unpaid invoices, you will lose access to your website or related services until payment is received.
• Deletions: If services are unpaid and overdue by 90 days, we reserve the right to delete your website and its associated content. Once deleted, the content cannot be restored. For financial hardships, please contact Jonas Troyer for potential solutions.

8. Links to Third-Party Websites

Our Service may include links to third-party websites or services that are not owned or controlled by Do It Right Roofing. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. You agree that Do It Right Roofing shall not be held responsible or liable, directly or indirectly, for any damage or loss caused by your use of or reliance on any such content, goods, or services available on or through third-party websites.

9. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If changes are material, we will provide notice of such changes by posting the updated Terms on our website at least 10 days before the new Terms take effect. What constitutes a “material change” will be determined solely at our discretion. Your continued use of the Service after changes have been made constitutes your acceptance of the new Terms.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Do It Right Roofing shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:

• Your use or inability to use the Service.
• Unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless Do It Right Roofing, its affiliates, and their respective employees, contractors, agents, officers, and directors from any claims, damages, obligations, losses, liabilities, costs, or debt arising out of:

• Your use and access to the Service.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property rights.
